Terms of Use

1. Acceptance of Terms

These Terms of Use ("Terms") are a binding agreement between you and Tupple Inc., a Delaware corporation ("Tupple," "we," "our," or "us"), operator of the WeatherStyle application ("App"). By downloading, installing, accessing, or using the App, you confirm you are at least 16 years old and agree to these Terms, our Privacy Policy, and Apple's standard EULA referenced below. If you do not agree, do not use the App.

2. Description of Service

WeatherStyle is a personal styling application that provides AI-generated outfit recommendations based on current weather conditions and your personal preferences. The App may include:

  • Daily outfit recommendations tailored to weather and style preferences
  • AI-generated outfit visualization images
  • Virtual try-on features using your uploaded photo
  • Audio narration of outfit recommendations
  • Closet management for saving favorite items
  • Premium subscription and credit-based features

3. Apple End User License Agreement (EULA)

If you obtained the App from the Apple App Store, you acknowledge and agree that these Terms are between you and Tupple, not Apple. Apple's standard Licensed Application End User License Agreement (available at apple.com/legal/internet-services/itunes/dev/stdeula) applies to your use of the App and is incorporated by reference. In the event of a conflict between these Terms and Apple's EULA, the more restrictive provision applicable to your use shall govern, except that these Terms govern the relationship between you and Tupple. Apple is a third-party beneficiary of these Terms and may enforce them against you.

4. Account Registration

You must create an account using Google Sign-In or Apple Sign-In to access the App. You are responsible for maintaining the security of your account and for all activity under it. You must provide accurate information and keep it up to date.

5. AI-Generated Content

WeatherStyle uses third-party artificial intelligence services (including Google Gemini and ElevenLabs) to generate outfit recommendations, images, and try-on composites. You acknowledge that:

  • AI-generated content is for personal styling inspiration and may not be perfectly accurate
  • Generated images are artistic representations and may not exactly match real-world clothing items
  • Try-on composites are AI-generated visualizations and should not be considered realistic photographs
  • We do not guarantee the availability, accuracy, or suitability of any AI-generated recommendation
  • AI providers may temporarily process your inputs to generate outputs; see our Privacy Policy for details

6. User Content & Try-On Photos

You retain ownership of photos you upload (e.g., Try-On photos). By uploading content, you grant Tupple a limited, worldwide, royalty-free license to store, process, and transform it solely for the purpose of providing the App's features (e.g., generating try-on composites). We do not use your photos for advertising, resale, or training third-party AI models. You represent that you have the right to upload any photo you submit and that you will not upload images of other people without their consent.

7. Credits & Payments

Certain features require credits. Credits may be obtained through:

  • Free tier: A limited number of complimentary credits upon registration
  • Premium subscription: Monthly credits included with an active subscription
  • Top-up purchases: One-time credit packs available for purchase
  • Referral program: Each user receives one referral code. You may redeem one referral code in your account's lifetime. Self-referrals, circular referrals, and use of multiple accounts to farm credits are prohibited and blocked. We reserve the right to revoke credits, suspend accounts, and refuse future participation if we detect fraud, abuse, fake accounts, or violations of these Terms. Referral credits have no cash value and may be modified or discontinued at any time.

iOS In-App Purchases & Auto-Renewing Subscriptions

Subscriptions and credit top-ups on iOS are processed through Apple's In-App Purchase system. The current subscription title, length, and price are displayed in the App prior to purchase.

  • Payment is charged to your Apple ID account at confirmation of purchase.
  • Your subscription automatically renews at the same price and duration unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • You can manage your subscription and turn off auto-renewal in Settings → [your name] → Subscriptions on your Apple device.
  • No cancellation of the current subscription is allowed during the active subscription period.
  • Top-up credit purchases are consumable, delivered immediately, and non-refundable except as required by law.

Web Payments

On the web, payments are processed securely by Stripe, Inc. We do not store your payment card details. Subscriptions auto-renew unless cancelled. You may cancel through your account settings or the Stripe customer portal.

Refunds

Refund requests for App Store purchases must be submitted to Apple at reportaproblem.apple.com. Tupple cannot issue refunds for App Store transactions. For Stripe purchases, contact us at the email below.

General

Credits are non-refundable and non-transferable. Unused monthly credits do not roll over. We reserve the right to modify pricing; changes to active subscriptions take effect at the next billing cycle, and we will provide reasonable notice.

8. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Upload content that is offensive, harmful, sexually explicit, or that violates third-party rights
  • Attempt to reverse-engineer, decompile, or hack the App
  • Circumvent credit limits, authentication, or security measures
  • Use automated tools to access the App (bots, scrapers, etc.)
  • Resell, redistribute, or commercially exploit AI-generated content
  • Upload photos of other people without their explicit consent
  • Upload photos of minors

9. Reporting & Content Moderation

You may report inappropriate or inaccurate AI-generated content through the in-App reporting feature. We review reports and may take action, including removing content or adjusting our AI prompts and filters. We commit to a zero-tolerance policy for objectionable content and abusive users in compliance with Apple App Store Guideline 1.2.

10. Intellectual Property

The App, its design, features, and original content are owned by Tupple Inc. and protected by U.S. and international copyright, trademark, and other laws. AI-generated outfit images created for you are provided for your personal, non-commercial use. You may share generated images for non-commercial purposes but may not claim them as original photography or human-created art.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR SUITABLE FOR ANY PARTICULAR PURPOSE. APPLE HAS NO WARRANTY OBLIGATION WHATSOEVER WITH RESPECT TO THE APP.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TUPPLE INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING RELIANCE ON AI-GENERATED RECOMMENDATIONS. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $50.

13. Indemnification

You agree to indemnify and hold harmless Tupple Inc., its officers, employees, and Apple Inc. (as third-party beneficiary) from any claims, damages, or expenses arising out of (a) your use of the App, (b) content you upload, or (c) your violation of these Terms or applicable law.

14. Account Termination

You may delete your account at any time through the App's settings. We reserve the right to suspend or terminate accounts that violate these Terms. Upon account deletion, all your data is permanently removed in accordance with our Privacy Policy.

15. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated through the App or via email and will require your renewed acceptance. Continued use of the App after changes constitutes acceptance of the updated Terms.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the App shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there. If you reside in the EEA, UK, or another jurisdiction with mandatory consumer protection laws, nothing in this section deprives you of the protection of those laws.
